Tiffany & Co took its case against eBay to federal appeals court yesterday, once again fueling the debate over who should be responsible for keeping counterfeit merch off of online auction sites. eBay, who won the case in district court last year, thinks brands should monitor sites themselves for knockoffs. Tiffany, on the other hand, feels this task should be up to the auction sites, since they're the ones profiting from sales. Whatever the outcome, WWD says "the case has the chance to set precedent in a field that has had little regulation." [WWD, sub. required]
